2. Eligibility to Purchase

To place an order with us, you must:

  • Provide accurate and complete personal details
  • Agree to these Terms and Conditions

3. Products and Availability

  • All products are subject to availability.
  • We reserve the right to discontinue any product at any time without notice.
  • Product images on our website are for illustration purposes and may differ slightly from the actual product.

4. Pricing and Payment

  • All prices are listed in South African Rand (ZAR) and include VAT (where applicable).
  • We do not use third-party payment platforms. Payments are processed securely and directly with EMX AFRICA.
  • Your order will only be processed once full payment is received.

5. Delivery

  • Delivery times are estimates and may vary due to factors beyond our control.
  • We are not responsible for delays caused by courier companies or customs clearance.
  • Risk of loss or damage passes to you upon delivery of the product.

6. Returns and Refunds

  • You may return unused products in their original packaging within 7 days of delivery for a refund or exchange.
  • Return shipping costs are the responsibility of the customer unless the product is defective.
  • Defective products will be replaced or repaired in line with the Consumer Protection Act (CPA).

7. Warranty

  • All e-bikes carry a manufacturer’s warranty as stated in the product description.
  • Warranty claims require proof of purchase.
  • The warranty does not cover damage caused by misuse, accidents, or unauthorised modifications.

8. Limitation of Liability

  • EMX AFRICA is not liable for any indirect, incidental, or consequential damages arising from the use of our products or website.
  • Use of e-bikes is at the rider’s own risk, and customers are responsible for complying with local laws and safety guidelines.

9. Privacy and Data Protection

  • We process your personal information in accordance with our Privacy Policy and POPIA requirements.
  • By placing an order, you consent to the collection and processing of your data as outlined in our Privacy Policy.

10. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective once posted on our website.

11. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of South African courts.
